Lindsay Lohan could be sent to the pokey this AM, because of those pesky alcohol ed classes she didn't complete on time.
Lindsay has now made good on the classes, but that may not be good enough for Judge Marsha Revel.
We've had cameras all over the Bev Hills courthouse, and you can see it unfold when Lindsay's case is called ... probably at around 8:45 AM PDT.

UPDATE: There's a recess while the prosecutor goes over the docs from Lindsay's alcohol ed program. Lindsay is in a small room near the courtroom with her lawyer, Shawn Chapman Holley, who is redacting some of the lawyer-client information in the docs, before turning them over to the prosecutor.
UPDATE: The prosecutor just railed on the Right On program for refusing to turn over documents showing Lindsay's performance. The judge ordered the Right On people to turn the documents over to prosecutor Danette Meyers, who is reviewing the docs now.

Prosecutor: I Can Prove Lindsay Was Drinking
Prosecutor Danette Meyers told the judge during Lindsay's probation violation hearing ... she has witnesses who will clearly show Lindsay was drinking after the MTV Movie Awards when her SCRAM bracelet showed a positive reading for alcohol. And there's more. Meyers insisted if Lindsay was drinking it should constitute a violation of her probation and subject her to jail. Judge Marsha Revel initially said drinking in and of itself was not a violation of probation -- it was just a bail restriction.
But Meyers argued under the terms of Lindsay's probation, she was required to obey all rules and regulations of the court, and no drinking was one of the rules. The judge seemed somewhat sympathetic to Meyers' argument. Meyers also suggested Lindsay's SCRAM device was tampered with. The judge will allow Meyers to call witnesses to prove if Lindsay was drinking. And the judge seemed skeptical that a SCRAM could go off where the person wearing it did not consume alcohol.

Danny DeVito was just minding his own business, performing his civic duty this AM when he showed up at the Beverly Hills courthouse for jury duty. Little did Danny know ... his trip through the metal detector would be chronicled for the world to see, because he showed up just after Lindsay Lohan arrived. Danny is in the jury assembly room right now. Someone needs to pick this dude as a juror, assuming, of course, it's not a Limoncello case.

Under the category ... "When it rains, it pours" ... Lindsay Lohan was just served with legal papers in a civil lawsuit while she was in the courtroom elevator. Lindsay was in the elevator at the Bev Hills Courthouse, on her way to Judge Marsha Revel's courtroom at about 8:25 this AM, when a process server working for a company called Tough As Nails attempted to hand Lindsay legal docs. The process server says Lindsay "freaked out," told people around her to get the guy out of the elevator and away from her. The process server says he attempted to hand Lindsay the papers but she would not take them so he dropped them on the elevator floor, by her feet. Under California law, generally a process server has done his job when he comes face to face with the person served. Lindsay is being sued for not paying for more than $17,000 worth of clothing, and accessories from Church, a store owned by Tough As Nails.
UPDATE: Big victory for Lindsay. The judge just ruled she will not allow the prosecutor to present evidence that Lindsay was drinking after the MTV Movie Awards on June 7. The hearing is not exclusively about whether Lindsay violated probation by not attending enough alcohol ed classes at the time of the last hearing.
UPDATE: The judge just shut down Michael Lohan's attempt to address the court, but will accept a letter from him.
UPDATE: Looking bad for Lindsay. Cheryl Marshall, co-owner of the Right On program, is testifying Lindsay violated the judge's command that LiLo attend classes once a week. There are a number of times -- 9 in all -- Lindsay skipped weeks at a time, and the program never notified the judge there was a problem.
UPDATE: The co-owner of the Right On program, Cheryl Marshall, is providing damaging testimony against Lindsay. Marshall admitted she violated the program by failing to attend the classes and coming up with a variety of excuses. In fact, the program determined in both May and August, 2009, that Lindsay was not in compliance with the program. In the August letter, the program determined Lindsay's excuses were "endless and disrespectful."
Michael Lohan is begging Judge Marsha Revel not to send his daughter to jail, but he's acknowledging that Lindsay's condition is desperate -- this according to a letter obtained by TMZ.
The letter, sent by Michael's lawyer, Lisa Bloom, asks the judge to make sure Lindsay's prescription drug use is carefully monitored. According to Bloom, "Michael desperately wants to avoid seeing his daughter become the next Hollywood statistic."
Bloom says Lindsay's 84 minutes in jail following her DUI conviction made L.A. County a "laughingstock of our criminal justice system." Bloom says with the realities of jail overcrowding, jail is no place for someone like Lindsay -- for a misdemeanor probation violation.
Bloom and Michael want the judge to order Lindsay to inpatient rehab, preferably a private facility in New York that also provides family therapy.
In the event the judge does not find Lindsay in violation of her probation, Bloom is asking the judge to keep her SCRAM on.
